Terms of Service

Article 1 – Purpose

These Terms of Service (ToS) define the terms of use of the Kalyvox service, an AI-powered automated phone-call qualification solution for businesses.

Article 2 – Definitions

  • Service: the Kalyvox AI phone-qualification platform accessible at kalyvox.ai
  • Customer: the business or professional subscribing to the Service
  • User: any of the Customer's staff members with access to the Service
  • Caller: any person calling the Customer's virtual phone number
  • Ticket: the structured summary generated after a qualified call
  • Voice bot: the AI assistant handling inbound calls

Article 3 – Sign-up and account

Access to the Service requires the creation of a professional account. The Customer warrants the accuracy of the information provided at sign-up (company name, registration number, professional contact details).

The Customer is responsible for managing its Users' access and for the confidentiality of credentials. Any activity carried out from an account is presumed to be performed by its holder.

Article 4 – Description of the Service

Kalyvox provides an intelligent phone reception solution including:

  • A dedicated virtual phone number
  • An AI voice bot answering inbound calls 24/7
  • Automatic intent qualification
  • Generation of tickets summarising each call
  • A dashboard for tracking calls and statistics
  • Customisable bot behaviour configuration
  • Conditional call transfer to a staff member

Article 5 – Pricing and payment

Current pricing is published on the website's Pricing page. The subscription includes:

  • Unlimited platform access for all of the Customer's Users
  • One phone number included
  • Inbound calls handled by the bot (subject to fair use)

Payment is made by credit card via Stripe. The subscription is monthly and renews automatically unless cancelled. The Customer may cancel at any time from their account; cancellation takes effect at the end of the current billing period.

Article 6 – Customer obligations

The Customer undertakes to:

  • Use the Service in line with its professional purpose
  • Inform Callers that conversations are recorded and analysed by AI
  • Configure the bot in compliance with applicable regulations
  • Refrain from using the Service for fraudulent, illegal or spam purposes
  • Refrain from circumventing security measures or reverse-engineering the Service
  • Respect Kalyvox's intellectual property rights

Article 7 – Kalyvox obligations

Kalyvox undertakes to:

  • Maintain Service availability (target 99.5% excluding planned maintenance)
  • Secure data in line with industry standards
  • Provide responsive technical support (email within 24 business hours)
  • Notify scheduled maintenance at least 48 hours in advance

Article 8 – Personal data

Personal-data processing is described in our Privacy Policy.

Important: the Customer is the data controller for its Callers' data. Kalyvox acts as a processor under the GDPR for call processing. A Data Processing Agreement (DPA) is available on request.

Article 9 – Intellectual property

The Service, its features, algorithms, interfaces and documentation are the exclusive property of KALYVOX SASU. The Customer is granted a personal, non-exclusive and non-transferable right of use for the duration of its subscription.

Data entered by the Customer remains its property. Kalyvox is granted a limited usage right for the provision of the Service and, in anonymised form, for improving its AI algorithms.

Article 10 – Limitation of liability

The Service relies on artificial-intelligence technology that may include interpretation errors or limitations. Kalyvox does not guarantee perfect accuracy of qualifications and transcriptions.

Kalyvox's liability is capped at the amount paid by the Customer over the previous 12 months. Kalyvox cannot be held liable for indirect damages, loss of revenue or business prejudice.

Article 11 – Termination

By the Customer: termination is possible at any time from the customer account. Access to the Service is maintained until the end of the current billing period.

By Kalyvox: in case of serious breach of the ToS (non-payment, fraudulent use), Kalyvox may suspend or terminate the account after a formal notice that has remained ineffective for 15 days.

Portability: upon termination, the Customer may request an export of its data in a structured format (JSON/CSV) for 30 days.

Article 12 – Force majeure

Neither party shall be liable for any delay or failure to perform resulting from a force-majeure event within the meaning of article 1218 of the French Civil Code (natural disaster, pandemic, generalised telecom outage, etc.).

Article 13 – Changes to the ToS

Kalyvox may amend these ToS at any time. Substantial changes will be notified by email at least 30 days before they take effect. Continued use of the Service after that date constitutes acceptance of the new ToS.

Article 14 – Governing law and disputes

These ToS are governed by French law. In case of dispute, the parties shall first attempt to find an amicable solution. Failing that, the courts of Toulouse shall have exclusive jurisdiction.

In accordance with article L.612-1 of the French Consumer Code (for non-professional customers), the Customer may resort free of charge to a consumer mediator.
